INFORMATION on the work of the Legislative Assembly of the Omsk Region of the fourth convocation in 2009


In April 2009 marked the 15th anniversary of the Legislative Assembly of the Omsk Region, the highest legislative (representative) body of state power in the Omsk Region.

The result of fifteen years of activity of the Legislative Assembly of the Omsk Region (hereinafter referred to as the Legislative Assembly), carried out in cooperation with the Governor of the Omsk Region and other subjects of legislative initiative, was the creation of a modern system of regional legislation aimed at implementing the constitutional provisions on federal, democratic, legal and social structure of the Russian Federation.

In 2009, in accordance with federal and regional legislation, taking into account the priorities defined by the strategic documents of the socio-economic development of the Russian Federation, the Omsk region, messages of the President of the Russian Federation to the Federal Assembly of the Russian Federation, the Legislative Assembly continued to work on improving legislative support various spheres of state, economic and social life of the population of the Omsk region.

The necessary legislative measures were taken in a timely manner aimed at stabilizing the regional economy and social sphere in the context of the ongoing financial and economic crisis in order to minimize its negative consequences for residents of the Omsk region.

The Legislative Assembly adopted 97 laws of the Omsk region, including: 18 – newly adopted laws, 76 – on the introduction amendments to the laws of the Omsk region, 3 – on the recognition of laws as no longer in force. The laws of the Omsk region, adopted by the Legislative Assembly and signed by the Governor of the Omsk region, are posted on the official website of the Legislative Assembly (http://omsk-parlament.ru/).


II. Information review of the legislative activities of the Legislative Assembly in 2009

1. Legislation of the Omsk region on the main democratic institutions for the development of the state and society
Public authorities of the Omsk region

The Law of the Omsk region “On combating corruption in the Omsk region” (No. 1154-OZ dated April 28, 2009) is aimed at protecting rights and freedoms of man and citizen, ensuring legality, law and order, public safety in the Omsk region. The law defines the basis for the activities of public authorities of the Omsk region in the field of anti-corruption, measures to prevent corruption, including conducting an anti-corruption examination of legal acts and their projects.

On amendments to Article 16 of the Law of the Omsk Region “On regulatory legal acts of the Omsk Region” (No. 1159-OZ dated May 29, 2009). It has been established that it is mandatory to conduct an anti-corruption examination of normative legal acts and their drafts.

On amendments to Article 7 of the Law of the Omsk Region “On the coat of arms and flag of the Omsk Region” (No. 1153-OZ dated April 28, 2009). The possibilities for using the flag of the Omsk region by citizens, public associations, enterprises, institutions and organizations have been expanded. Its use is allowed not only during official events, but also in other cases, if such use does not violate the flag.
On amendments to the Law of the Omsk Region “On the procedure for providing state guarantees in the Omsk Region” (No. 1169-OZ dated June 23, 2009). The changes concern the establishment of an open list of recipients of state guarantees in the Omsk region.
Elections, referendums and other forms of direct democracy in the Omsk region

On amendments to the Law of the Omsk Region “On elections of deputies of the Legislative Assembly of the Omsk Region” and the Law of the Omsk Region “On elections to local government bodies” Omsk region" (No. 1158-OZ dated May 29, 2009). Regional laws have been brought into line with federal legislation in connection with the abolition of the electoral deposit.

On amendments to Article 15 of the Law of the Omsk Region “On the Election Commission of the Omsk Region” (No. 1160-OZ dated May 29, 2009). Additional requirements (prohibitions) have been established for a member of the regional election commission working on a permanent (full-time) basis.

On amendments to certain laws of the Omsk region" (No. 1190-OZ dated 10/06/2009; No. 1210-OZ dated 12/08/2009). To bring regional legislation into line with federal legislation, amendments were made to the regional laws: “On the Election Commission of the Omsk Region”, “On the Election of Deputies of the Legislative Assembly of the Omsk Region”, “On Elections to Local Government Bodies of the Omsk Region”, “On the Referendum of the Omsk Region” and “On the local referendum in the Omsk region”, - in terms of providing free air time and free print space to inform voters and participants referendum, pre-election campaigning and campaigning on referendum issues. The minimum term of office of a deputy of a representative body of local self-government has been changed.

On the development of the Russian Cossacks in the Omsk region" (No. 1189-OZ dated 10/06/2009). The law establishes the legal, financial, economic, and social basis for the activities of Cossack societies in the Omsk region; the powers of state authorities in the sphere of development of the Russian Cossacks in the Omsk region are delineated; the types of activities in which members of Cossack societies can be involved are determined; certain issues of attracting members of Cossack societies to the public service of the Russian Cossacks in the Omsk region have been resolved.
Administrative-territorial structure of the Omsk region

On amendments to the Law of the Omsk region “On the administrative-territorial structure of the Omsk region and the procedure for changing it” (No. 1198-OZ dated November 3, 2009; No. 1224-OZ < dated 12/29/2009). The official names of some settlements have been clarified. In addition, the village of Nagaevo and the village of Kedrovy were excluded from the Register of administrative-territorial entities and settlements of the Tara district of the Omsk region due to the lack of duly registered population, residential buildings and production facilities.
Local self-government in the Omsk region
From January 1, 2009, the Federal Law of October 6, 2003 No. 131-FZ “On the general principles of organizing local self-government in the Russian Federation” (hereinafter) came into full force throughout the Russian Federation − Federal Law No. 131-FZ). In the Omsk region, all the tasks set for the constituent entities of the Russian Federation by Federal Law No. 131-FZ have been completed. Of particular importance in carrying out the reform of local self-government was the clear interaction of the Legislative Assembly with the Governor and the Government of the Omsk region.
In 2009, a number of regional laws were adopted regulating or clarifying certain areas of activity of local governments in the Omsk region.

On vesting local government bodies of municipal districts of the Omsk region with state powers in the field of supporting agricultural production (No. 1138-OZ
dated 02/11/2009). The law was adopted in order to reduce the procedure for completing documents to receive subsidies for citizens running private farms. A procedure has been established for the transfer of state powers in the field of supporting agricultural production to local governments of municipal districts of the Omsk region to ensure the availability of credit resources for citizens running private farming;

On amendments to the Law of the Omsk Region “On the procedure for determining by local government bodies of the Omsk Region places of public catering in which retail sale and consumption (drinking) of beer and drinks made on its basis are not permitted” (No. 1144- OZ dated 03/02/2009).
State and municipal service in the Omsk region
In connection with the adoption of the Federal Law “On Combating Corruption”, as well as Decrees of the President of the Russian Federation of May 18, 2009 No. 557, 558, 559 and 561, laws of Omsk were adopted region:

On amendments to the Code on public positions of the Omsk region and the state civil service of the Omsk region (No. 1191-OZ dated 10/06/2009). The powers of the Governor of the Omsk Region have been established to approve documents aimed at streamlining relations regarding the provision of information on income, property and property-related obligations. Changes have been made regarding the settlement of relations related to the period of performance of official duties by the first deputy, deputy minister of the Omsk region in the event of termination of the powers of the minister of the Omsk region.

On amendments to certain laws of the Omsk region (No. 1216-OZ dated 12/08/2009). Certain provisions of the Code on Public Positions and State Civil Service of the Omsk Region (hereinafter referred to as the Code) and the Law of the Omsk Region “On the length of service of the state civil service of the Omsk Region” are brought into compliance with federal and regional legislation. The Code is supplemented by provisions giving the Governor of the Omsk Region the authority to approve provisions on verifying the accuracy and completeness of information on income, property and property-related obligations provided by persons applying for a government position in the Omsk Region, as well as positions in the state civil service of the Omsk Region.
In order to bring regional legislation into compliance with the Federal Law “On Municipal Service in the Russian Federation”, taking into account the changes introduced by the Federal Law of November 25, 2008 No. 219-FZ, and the transition from qualification categories to the assignment of class ranks to municipal employees adopted the laws of the Omsk region:

On the relationship between municipal service positions and state civil service positions in the Omsk region (No. 1148-OZ dated 04/06/2009). The ratio is established taking into account the qualification requirements for the relevant positions of the municipal service and positions of the state civil service of the Omsk region;

On the class ranks of municipal employees in the Omsk region (No. 1209-OZ dated 12/08/2009). A procedure has been established for assigning class ranks to municipal employees, their retention upon transfer to other positions in the municipal service and upon dismissal from municipal service in the Omsk region.

2. Legislation of the Omsk region on the budget, budget process, taxes
Budget and budget process

On amendments to the Law of the Omsk region “On the regional budget for 2009” (No. 1143-OZ dated 02.12.2009; No. 1145 -OZ dated 04/03/2009; No. 1152-OZ dated 04/24/2009; No. 1166-OZ dated 06/01/2009; No. 1167-OZ dated 06/23/2009; No. 1170-OZ dated 07/21/2009, No. 1185-OZ dated 09/30/2009; 01.12.2009; No. 1218-OZ dated 29.12.2009). The changes are mainly related to the clarification of funds to be received from the federal budget, as well as with the aim of increasing the efficiency of using budget funds in the conditions of the financial and economic crisis, optimizing and saving budget expenditures. Additional revenues of interbudgetary transfers from the federal budget are aimed at:
providing citizens with subsidies to pay for housing and utilities;
to support agriculture;
state support for small and medium-sized businesses, including peasant farms;
providing new microdistricts with roads;
providing living quarters for orphans left without parental care, as well as children under guardianship who do not have assigned living quarters; Providing certain categories of citizens with social services for additional free medical care in terms of providing medicines, medical products, as well as specialized medical nutrition products for disabled children;
payment of one-time monetary compensation to certain categories of disabled people, etc.
Within the framework of interbudgetary relations, budgetary allocations are aimed at the construction of schools in the village. Pavlogradka (600 seats) and
s. Znamenskoye (for 440 places), major repairs and material and technical equipment of facilities, construction and reconstruction of roads that are municipally owned in the Omsk region, etc.
Expenditures that are not of a priority or social nature have been reduced. Social obligations have been fulfilled in full.

On the regional budget for 2010 (No. 1219-OZ dated December 29, 2009). The budget was approved for revenues in the amount of 31.3 billion rubles, expenses - 33.2 billion rubles. The budget deficit amounted to 1.9 billion rubles, or 7.7 percent of total revenues excluding gratuitous receipts from the federal budget.
In the context of a slowdown in socio-economic development, special attention is paid to balancing and optimizing the regional budget. Cost reductions in 2010 are planned in almost all respects, with the exception of the social sphere. 70.9 percent of the total budget expenditures are financing education, healthcare, culture, physical education and sports, and social policy. Of the listed expenses, 13.9 billion rubles, or 46.8 percent, are wages, including for municipalities.
Of the 6.3 billion rubles allocated for social policy,
4.3 billion rubles will be the costs of providing individual social support measures established by federal and regional legislation. All social benefits are preserved. However, payments will become targeted and will be provided only to those who really need government support: first of all, these are citizens with incomes below the subsistence level. 43.2 million rubles will be paid to certain categories of citizens as part of events dedicated to the 65th anniversary of Victory in the Great Patriotic War, as well as to the Day of Remembrance and Sorrow.

On the budget of the territorial compulsory health insurance fund of the Omsk region for 2010 (No. 1227-OZ dated December 29, 2009). The Fund's budget is balanced in terms of income and expenses and amounts to 3.2 billion rubles.
In 2010, the fund is supposed to send the fund’s financial resources for the following purposes: the implementation of the territorial program of compulsory medical insurance within the framework of the Basic Program of Compulsory Medical Insurance; conducting a medical examination of children-orphans who are in stationary institutions and children in difficult life situations; Financial support for the provision of additional medical care carried out by the medical personnel of the district service (doctors-therapists, pediatricians, general practitioners (family doctors), medical sisters).

On regional standards of public services (works) of the Omsk region (No. 1194-OZ dated 08.10.2009). The law was adopted by the Budget Code of the Russian Federation regarding the implementation of the mechanism of planning budget allocations for the provision of public services based on a state assignment. In the process of compiling the regional budget, regional standards are used by the executive authorities of the Omsk region in the formation of the state assignment for the provision of public services (works). The regulation of the entire cycle of works on the introduction of budget planning of regional standards from the moment of development to the assessment of their compliance helps to create a mechanism for monitoring compliance with regional standards, improving the liability of performers (suppliers) for the quality of public services they provided.

On amendments to the Law of the Omsk Region “On Inter-Byzhegent Relations in the Omsk Region” (No. 1151-OZ dated 07.04.2009; No. 1195-OZ dated 08.10.2009). In order to bring the regional legislation in accordance with the federal and improving the procedure for the provision of inter -budget transfers from the budget of the Omsk region, changes were made to the articles of the basic law governing the issues of inter -budget transfers provided from local budgets. The methodology for calculating the additional rate of deductions from tax on income of individuals to local budgets has been clarified. The methodology for the distribution of the volume of the regional fund of financial support for the municipal regions of the Omsk region regarding the exclusion of the second and third stages of the distribution of subsidies to equalize budgetary provision between municipal regions (urban district) based on the growth rate of tax revenues and income from the use of property in municipal property.

on amendments to the Law of the Omsk Region “On the Budget Process in the Omsk Region” (No. 1155-OZ dated 04.28.2009). In accordance with Art. 264.4 of the Budget Code of the Russian Federation establishes the procedure for the external audit of the annual report on the execution of the budget of the subject of the Russian Federation.
by the laws of the Omsk Region No. 1164-OZ dated 05.29.2009 and No. 1222-OZ
dated December 29, 2009 amended the Law of the Omsk Region “On the budget of the territorial fund of compulsory medical insurance of the Omsk region for 2009”. The revenues of the fund’s budget, the structure of expenses and the inter -budget transfers received from other budgets were revised for 2009. As a result of the changes made, the revenue of the budget increased by 10.4 million rubles.

on the approval of the methodology for the distribution of subventions to the budgets of municipalities of the Omsk region for the exercise of state powers to draw up (change, supplement) lists of candidates for jurors of federal courts of general jurisdiction in the Russian Federation (No. 1214-OZ dated 08.12.2009). The technique contains formulas for calculating the subvention allocated for the exercise of state powers for the annual compilation (change, supplement) lists of jury candidates, and the estimated need of the Omsk region in subventions.
In order to control the spending of budgetary funds, laws have been considered and adopted: “On the execution of the regional budget for 2008” (No. 1181-OZ dated 07.23.2009), “On the execution of the budget of the territorial fund of compulsory medical insurance of the Omsk region for 2008” (No. 1175-OZ dated 07.21.2009).
Taxes

on amendments to Article 2 of the Law of the Omsk Region “On Transport Tax” (No. 1183-OZ dated 07.23.2009). From January 1, 2010, the minimum increase in tax rate was established for the most common category of vehicles - cars with engine power up to 100 horsepower. In other categories of cars, the rate increases by 50 percent. The expected receipt of funds in the regional budget is about 240 million rubles.

On amendments to Article 3 of the Law of the Omsk Region “On Transport Tax” (No. 1206-OZ dated November 27, 2009). Institutions that receive subsidies from the regional and (or) local budgets are exempted from paying the transport tax in order to implement the state (municipal) assignment, which will optimize the financing system for autonomous institutions.

On amendments to Article 1 of the Law of the Omsk Region “On the establishment of gambling tax rates” (No. 1193-OZ dated 08.10.2009). In connection with the ban on July 1, 2009, the activities of gambling establishments, with the exception of bookmakers and totalizers outside gambling zones, are excluded from the basic regional law the relevant articles that establish tax rates for tax objects as a gaming table and a slot machine.

On amendments to the Law of the Omsk Region “On the Property of Organizations” (No. 1207-OZ dated November 27, 2009). A zero tax rate was established for airports, as well as institutions receiving subsidies from the regional or local budgets in order to implement the state (municipal) assignment.

3. The legislation of the Omsk region in the field of social policy
Social protection of the population

on amendments to the Code of the Omsk Region on the social protection of certain categories of citizens (No. 1137-OZ dated 11.02.2009;
No. 1157-OZ 06/06/2009). The Code is brought into line with federal law in order to target the targeted direction of social support measures of certain categories of citizens and increasing the efficiency of spending the funds of the regional budget. From January 1, 2010, the provision of social support measures for the payment of housing and utilities to certain categories of citizens in the Omsk region will be carried out in the form of compensation. The conditions for accounting for persons as part of a large family, the procedure for appointing and paying benefits to citizens with children and pregnant women are clarified.

On amendments to the Law of the Omsk Region “On State Awards of the Omsk Region, awards of the Higher bodies of state power of the Omsk region and honorary titles of the Omsk region” (No. 1171-OZ dated 07.21.2009). In order to encourage fathers who worthy of raising children without a mother, preserving family traditions and values, increasing the status of a father in society established the grounds for awarding the Father's Valor medal.

On the cost of living of a pensioner in the Omsk region for 2010 (No. 1184-OZ dated 09.30.2009). In accordance with the Federal Law “On the subsistence minimum in the Russian Federation” since January 1, 2010, pensioners, the material support of which does not reach the cost of living of a pensioner, is provided with a social surcharge for a pension, consisting of federal and regional surcharges, at the expense of the corresponding budgets. The cost of living of a pensioner in the Omsk region for 2010 was set at 4665 rubles.

On amendments to the Law of the Omsk Region “On the Consumer Ball in the Omsk Region (No. 1204-OZ dated 03.11.2009). The procedure for establishing the cost of living for a pensioner in the Omsk region is determined in order to establish social surcharges to a pension provided for by the Federal Law “On State Social Assistance”.

Labor and employment of the population
In order to ensure additional guarantees of employment of citizens who are especially in need of social protection, the Law “On Quotas of jobs in the Omsk region” was adopted (No. 1174-OZ dated 21.07.2009). The law establishes the legal basis for the quotation of jobs for hiring disabled people in the organization, regardless of the organizational and legal form and form of ownership. Health, physical education and sports

on amendments to Article 3 of the Law of the Omsk Region “On the Protection of Health of the Population of the Omsk Region” (No. 1136-OZ dated 11.02.2009). Amendments were made to the Law of the Omsk Region “On the Protection of Health of the Population of the Omsk Region” (No. 1173-OZ dated 07.21.2009; No. 1215-OZ dated 08.12.2009).
