about the state of legislation of the Omsk region in 2014
The report on the state of legislation of the Omsk region in 2014 (hereinafter referred to as the Report) was prepared in accordance with the decision of the Presidium of the Council of Legislators of the Russian Federation at the Federal Assembly of the Russian Federation dated February 4, 2014 "On preparation of the Report on the state of Russian legislation in 2014."
The report is one of the conditions for ensuring the completeness of regional legislation, its consistency and progressive updating in accordance with the current political and socio-economic objectives of the country's development.
The information contained in the Report should help identify trends in the development of legislation, increase the efficiency of the legislative process and the stability of legislative regulation.
As of December 31, 2014, 168 basic laws of the Omsk region have been adopted and are in force.
Subjects of the right of legislative initiative submitted 129 draft laws of the Omsk region to the Legislative Assembly of the Omsk Region (hereinafter referred to as the Legislative Assembly), including:

In 2014, the Legislative Assembly adopted 109 laws of the Omsk region. Of these, 13 are basic laws of the Omsk region, 94 - on amendments to the laws of the Omsk region, 1 - on invalidation and amendment of certain laws of the Omsk region, 1 - on the suspension of certain provisions of the law.

Section 1. Information on the state of legislation of the Omsk region
in 2014 (by areas of regulated relations)

Electoral legislation

Changes made to the regional electoral legislation in 2014 are related to the harmonization of the laws of the Omsk region with the Federal Law of June 12, 2002 No. 67-FZ “On the basic guarantees of electoral rights and the right to participate in a referendum of citizens of the Russian Federation”, which was changed 8 times during 2014. In addition, certain legal provisions of the laws were adjusted based on the practice of their application.

Law of the Omsk Region dated March 24, 2014 No. 1618-OZ “On Amendments to the Law of the Omsk Region “On Elections to Local Government Bodies of the Omsk Region” clarifies the use of electoral systems in municipal elections of representative bodies of municipalities of the Omsk Region.

The procedure for nominating candidates in single-mandate (multi-member) electoral districts during by-elections and the grounds for invalidating voter signatures have been clarified.

Law of the Omsk Region dated June 2, 2014 No. 1635-OZ “On Amendments to Certain Laws of the Omsk Region” clarifies the passive suffrage of citizens of the Russian Federation sentenced to imprisonment for committing serious and especially serious crimes.

The amount of expenses for financing the election campaign of a candidate for elections of local government bodies in rural settlements without opening a special election account has been increased.

The mechanism for transferring vacant deputy mandates to regional groups has been clarified.

Law of the Omsk Region dated October 8, 2014 No. 1668-OZ “On Amendments to Certain Laws of the Omsk Region” clarifies the requirements for documents submitted to election commissions for notification of the nomination and registration of candidates, lists of candidates. The conditions for registration of a candidate, a list of candidates for elections of deputies of the Legislative Assembly, deputies of representative bodies of municipalities of the Omsk region have been established.

The minimum percentage of votes required to admit lists of candidates to the distribution of deputy mandates in the Legislative Assembly has been lowered from 7 to 5 percent of the number of votes of voters who took part in the voting.

The number of voter signatures required to register a candidate, a list of candidates for elections of deputies to the Legislative Assembly, deputies of representative bodies of municipalities of the Omsk region has been established.

The possibility of early voting in elections of deputies of representative bodies of municipalities of the Omsk region is provided.

Law of the Omsk Region dated December 25, 2014 No. 1696-OZ “On Amendments to Certain Laws of the Omsk Region in the Field of Election Legislation” stipulates that in elections to local government bodies of the Omsk Region the line “Against all candidates” (“Against all lists of candidates") does not fit on the ballot paper.

In accordance with paragraph 6 of Article 1 of the Federal Law of June 12, 2002 No. 67-FZ “On the Basic Guarantees of Electoral Rights and the Right to Participate in a Referendum of Citizens of the Russian Federation” of the constitution (statutes), the laws of the constituent entities of the Russian Federation on elections and referendums do not must contradict the specified Federal Law.

In 2014, paramount importance was attached to ensuring compliance of the laws of the Omsk region in the field of electoral legislation with this Federal Law. Current practice allows us to conclude that there is a fairly effective mechanism for ensuring compliance of the laws of the Omsk region in the field of electoral legislation with the Federal Law of June 12, 2002 No. 67-FZ “On the basic guarantees of electoral rights and the right to participate in a referendum of citizens of the Russian Federation.”
Given that the legislation of the Omsk region on elections and referendums has not been codified, similar provisions of the laws relating to the establishment of terms, conditions, etc. should be unified.
Legislation on the status and procedure for the formation of public authorities of a constituent entity of the Russian Federation and on public service in a constituent entity of the Russian Federation
In 2014, changes were made to the Code of Public Positions of the Omsk Region and the State Civil Service of the Omsk Region.

Law of the Omsk Region dated April 23, 2014 No. 1624-OZ “On Amendments to the Code on Public Positions of the Omsk Region and the State Civil Service of the Omsk Region”, certain provisions of the Code regulating the material support of state civil servants are amended in accordance with Resolution of the Supreme Court of the Russian Federation dated December 18, 2013 No. 50-APG13-12.

In addition, the qualification requirements for length of service in the state civil service for persons with specialist or master's degrees with honors have been changed. It has been established that payment of a one-time benefit upon termination of an official relationship is carried out without filing an application.

The Law of the Omsk Region dated June 2, 2014 No. 1636-OZ “On Amendments to the Code on Public Positions of the Omsk Region and the State Civil Service of the Omsk Region” clarified the procedure for calculating pensions for long service to persons holding public positions in the Omsk Region , positions of the state civil service of the Omsk region.

The Law of the Omsk Region dated December 25, 2014 No. 1700-OZ "On Amendments to the Code on Public Positions of the Omsk Region and the State Civil Service of the Omsk Region" was prepared in connection with the adoption of the Federal Law dated 28 December 2013 No. 400-FZ "On insurance pensions" and provides for the replacement of the concept of “labor pension” with the concept of “insurance pension”.

The Law of the Omsk Region dated April 23, 2014 No. 1625-OZ “On Amendments to the Law of the Omsk Region “On the Experience of the State Civil Service of the Omsk Region” clarified periods of service (work) included (counted) in experience in the state civil service of the Omsk region.

The degree of investment attractiveness of the region is a determining condition for active investment activity and effective socio-economic development of the region. Therefore, the improvement of tax legislation is aimed at creating the necessary and favorable conditions for the intensification of economic growth, improving the quality of life of the population.

In order to stimulate investment activity in the Omsk region, the Omsk Region Law of December 25, 2012 No. 1505-OZ “On Investment Tax Credit” is in force, establishing the grounds and conditions of the investment tax credit.

In the Omsk region, the opportunity of a constituent entity of the Russian Federation to establish the specifics of determining the tax base for the property tax of organizations has not been used. There is a problem in compiling a List of real estate objects, for which the tax base is determined as the cadastral value. The procedure for compiling such a List requires the development of recommendations at the federal level.

Further improvement of the legislation on taxes and fees should be aimed at creating incentives for increasing the tax base in the Omsk region and using the powers granted to the constituent entity of the Russian Federation in the field of tax legislation in full.

 

Legislation regulating relations in the sphere state property of a constituent entity of the Russian Federation

The basics of property management in the Omsk region and the procedure for exercising the powers of the owner by state authorities of the Omsk region, organizations, officials and other persons in relation to property owned by the right of ownership of the Omsk region are established by the Law of the Omsk region dated July 6, 2005 No. 652-OZ " On property management of the Omsk region."

Interaction of the Legislative Assembly with federal government bodies

In 2014, 1,264 draft federal laws were received from the State Duma of the Federal Assembly of the Russian Federation for the preparation of reviews, comments and proposals.

The largest number of federal bills were considered by the committees of the Legislative Assembly: on legislation - 483, on economic policy and investment - 280, on social policy - 190, on financial and budget policy - 156, on agrarian policy, natural resources and ecology - 128.

On March 13, 2014, the deputies of the Legislative Assembly adopted an appeal to the President of the Russian Federation and the Federal Assembly of the Russian Federation in connection with the situation that has developed in Ukraine.

The Legislative Assembly approved the Law of the Russian Federation on the amendment to the Constitution of the Russian Federation "On the Federation Council of the Federal Assembly of the Russian Federation."

The Legislative Assembly supported the adoption of the draft federal law "On the honorary title of the Russian Federation "City of Labor Glory".

Deputies of the Legislative Assembly supported the appeal of the Legislative Assembly of the Republic of Karelia on the issue of accelerating the consideration of the draft federal law No. 23392-6 "On Amendments to the Federal Law "On the Procedure for the Free Transfer of Military Real Estate to the Ownership of Subjects of the Russian Federation - Federal Cities of Moscow and St. Petersburg, Municipal Property and Amendments to Certain Legislative Acts of the Russian Federation."

The Legislative Assembly supported the appeal of the Tyumen Regional Duma on the issue of the condition of federal highways R-402 "Tyumen - Yalutorovsk - Ishim - Omsk" and R-404 "Tyumen - Tobolsk - Khanty-Mansiysk".

On September 25, 2014, at a meeting of the Legislative Assembly, a report was heard and the activities of a member of the Federation Council of the Federal Assembly of the Russian Federation were approved – representative from the Legislative Assembly of the Omsk region A.I. Golushko.

Chairman of the Legislative Assembly V.A. Deputies of the Legislative Assembly participated in parliamentary hearings, round tables, video conferences, seminars and other events held by the Federal Assembly of the Russian Federation.

Representatives of the prosecutor's office of the Omsk region, the Ministry of Internal Affairs of Russia for the Omsk region took an active part in meetings of working groups to prepare proposals for improving administrative legislation, legislation in the field of regulation of retail sales of alcoholic beverages, for the development of a draft law on the social adaptation of persons released from criminal institutions -executive system. Proposals to improve regional legislation have been repeatedly made.

The Department of the Ministry of Justice of Russia for the Omsk Region is carrying out systematic work to conduct legal and anti-corruption examinations of legislative acts. In December, an Agreement was concluded between the Legislative Assembly of the Omsk Region and the Department of the Ministry of Justice of Russia for the Omsk Region on interdepartmental electronic document flow.

On tax policy issues, the Legislative Assembly effectively interacts with the Federal Tax Service for the Omsk Region. At her request, the adoption of draft federal law No. 613254-6 “On amendments to certain legislative acts of the Russian Federation in terms of ensuring the reliability of information provided during state registration of legal entities and individual entrepreneurs” was supported.

Territorial bodies of federal executive authorities also provide advisory and expert assistance to the committees of the Legislative Assembly in the legislative process.

 

Interaction of the Legislative Assembly with the state authorities of the Omsk Region

The Legislative Assembly continues to actively interact with the Governor of the Omsk Region, the Government of the Omsk Region, the executive bodies of state power of the Omsk Region, the Control and Accounts Chamber of the Omsk Region, the Electoral Commission of the Omsk Region in the preparation and revision of draft regional laws, and the preparation of proposals for improving regional and federal legislation.

On June 19, at a meeting of the Legislative Assembly, Governor of the Omsk Region V.I. Nazarov presented a Report on the results of the activities of the Government of the Omsk Region in 2013.

On September 25, the Legislative Assembly heard and took into account the report of the Governor of the Omsk Region V.I. Nazarova "On the main directions of the budget, economic and social policy of the Omsk Region in 2015" (message of the Governor of the Omsk Region to the Legislative Assembly on the state of affairs in the Omsk Region).

On requests and appeals from deputies of the Legislative Assembly, information from the Minister of Economy of the Omsk Region, the Minister of Development of the Transport Complex of the Omsk Region was heard.

Deputies of the Legislative Assembly took part in meetings of the Government of Omsk Region, boards of ministries and departments of Omsk Region, in meetings held by executive bodies of state power of Omsk Region.

Representatives of government bodies of the Omsk region took part in meetings of the Legislative Assembly, events of the Legislative Assembly, meetings of committees of the Legislative Assembly and working groups.

 

Interaction of the Legislative Assembly with local government bodies of municipalities of the Omsk region

The Legislative Assembly, in order to interact with the representative bodies of municipal districts of the Omsk region in the legislative process, sent more than 40 draft laws of the Omsk region for the preparation of comments and proposals.

The Council of the Tara Municipal District submitted to the Legislative Assembly as a legislative initiative the draft law of the Omsk Region "On Amendments to the Law of the Omsk Region "On the Borders and Status of Municipal Entities of the Omsk Region" regarding changes in the boundaries between the Tara City and Chekrushansky Rural Municipalities Tarsky municipal district of the Omsk region within the boundaries of the Tarsky municipal district of the Omsk region.

December 19 in r.p. Other areas of activity of the Legislative Assembly

On April 10, an extended meeting of the Legislative Assembly was held dedicated to the 20th anniversary of its activity, in which the Governor of the Omsk Region, members of the Government of the Omsk Region, representatives of federal government bodies and local governments of the Omsk Region took part.

As part of the anniversary events, seminars, round tables, meetings in the Legislative Assembly with students and teachers of educational organizations in the Omsk region were held, thematic exhibitions were organized in the Omsk State Regional Scientific Library named after A.S. Pushkin, municipal districts of the Omsk region.

At the meetings of the Legislative Assembly, 25 justices of the peace of the Omsk region, an auditor of the Chamber of Control and Accounts of the Omsk region were appointed, elections were scheduled for the post of chairman of the Chamber of Control and Accounts of the Omsk region, and the candidacy of the coordinator of the regional tripartite commission for regulating social and labor relations was agreed upon.

Three meetings of the Youth Chamber of Deputies at the Legislative Assembly of the Omsk Region were held.

As part of international contacts, on September 26, the Legislative Assembly was visited by scientists from the University of Economics of the Serbian city of Novi Sad, headed by Professor Nenad Vunjak, and employees of Omsk State University named after F.M. Dostoevsky. Deputies of the Legislative Assembly and guests discussed issues of developing cooperation between regions, the possibility of training qualified personnel based on the exchange of experience, and mastering advanced management technologies.

The analysis of the state of legislation in the Omsk region in 2014 allows us to come to the following conclusions.

In general, the necessary legislative framework has been formed for the implementation of targeted work to implement the tasks of socio-economic development of the Omsk region.

Systematic work on monitoring legislation, law enforcement practice, timely adoption of regional laws make it possible to ensure a situation in which the legislation of the Omsk region complies with federal legislation and strategic directions of activity contained in the messages of the President of the Russian Federation, his program articles, “May” decrees and speeches .

The next stage in the development of regional legislation is to improve the legal quality of legislation. It is necessary to avoid the practice of hasty adoption of acts of regional legislation, as this entails contradictions and gaps in legal regulation.

The instability of legal regulation, especially in the areas of electoral and administrative legislation, negatively affects law enforcement practice. Frequent changes to existing regulations should be avoided.

It is necessary to unify the legal regulation of similar social relations. Analyze the elements and sanctions of administrative offenses taking into account judicial practice, legal positions of the Constitutional Court of the Russian Federation.

An important direction in the development of legislation is the expansion of forms of participation of the expert community and citizens in the legislative process. It is necessary to pay special attention to expert support, public examination, and public hearings. Actively use mechanisms such as regulatory impact assessment, anti-corruption examination of legal acts and their projects. In order to analyze and evaluate adopted legislative acts, develop public control in the field of law enforcement.
