The report on the state of legislation of the Omsk region in 2014 (hereinafter referred to as the Report) was prepared in accordance with the decision of the Presidium of the Council of Legislators of the Russian Federation at the Federal Assembly of the Russian Federation dated February 4, 2014 "On preparation of the Report on the state of Russian legislation in 2014."

The report is one of the conditions for ensuring the completeness of regional legislation, its consistency and progressive updating in accordance with the current political and socio-economic objectives of the country's development.

The information contained in the Report should help identify trends in the development of legislation, increase the efficiency of the legislative process and the stability of legislative regulation.

As of December 31, 2014, 168 basic laws of the Omsk region have been adopted and are in force.

In 2014, the Legislative Assembly adopted 109 laws of the Omsk region. Of these, 13 are basic laws of the Omsk region, 94 - on amendments to the laws of the Omsk region, 1 - on invalidation and amendment of certain laws of the Omsk region, 1 - on the suspension of certain provisions of the law.

in 2014 (by areas of regulated relations)

Electoral legislation

Changes made to the regional electoral legislation in 2014 are related to the harmonization of the laws of the Omsk region with the Federal Law of June 12, 2002 No. 67-FZ “On the basic guarantees of electoral rights and the right to participate in a referendum of citizens of the Russian Federation”, which was changed 8 times during 2014. In addition, certain legal provisions of the laws were adjusted based on the practice of their application.

Law of the Omsk Region dated March 24, 2014 No. 1618-OZ “On Amendments to the Law of the Omsk Region “On Elections to Local Government Bodies of the Omsk Region” clarifies the use of electoral systems in municipal elections of representative bodies of municipalities of the Omsk Region.

The procedure for nominating candidates in single-mandate (multi-member) electoral districts during by-elections and the grounds for invalidating voter signatures have been clarified.

Law of the Omsk Region dated June 2, 2014 No. 1635-OZ “On Amendments to Certain Laws of the Omsk Region” clarifies the passive suffrage of citizens of the Russian Federation sentenced to imprisonment for committing serious and especially serious crimes.

The amount of expenses for financing the election campaign of a candidate for elections of local government bodies in rural settlements without opening a special election account has been increased.

The mechanism for transferring vacant deputy mandates to regional groups has been clarified.

Law of the Omsk Region dated October 8, 2014 No. 1668-OZ “On Amendments to Certain Laws of the Omsk Region” clarifies the requirements for documents submitted to election commissions for notification of the nomination and registration of candidates, lists of candidates. The conditions for registration of a candidate, a list of candidates for elections of deputies of the Legislative Assembly, deputies of representative bodies of municipalities of the Omsk region have been established.

The minimum percentage of votes required to admit lists of candidates to the distribution of deputy mandates in the Legislative Assembly has been lowered from 7 to 5 percent of the number of votes of voters who took part in the voting.

The number of voter signatures required to register a candidate, a list of candidates for elections of deputies to the Legislative Assembly, deputies of representative bodies of municipalities of the Omsk region has been established.

The possibility of early voting in elections of deputies of representative bodies of municipalities of the Omsk region is provided.

Law of the Omsk Region dated December 25, 2014 No. 1696-OZ “On Amendments to Certain Laws of the Omsk Region in the Field of Election Legislation” stipulates that in elections to local government bodies of the Omsk Region the line “Against all candidates” (“Against all lists of candidates") does not fit on the ballot paper.

In accordance with paragraph 6 of Article 1 of the Federal Law of June 12, 2002 No. 67-FZ “On the Basic Guarantees of Electoral Rights and the Right to Participate in a Referendum of Citizens of the Russian Federation” of the constitution (statutes), the laws of the constituent entities of the Russian Federation on elections and referendums do not must contradict the specified Federal Law.

In 2014, paramount importance was attached to ensuring compliance of the laws of the Omsk region in the field of electoral legislation with this Federal Law. Current practice allows us to conclude that there is a fairly effective mechanism for ensuring compliance of the laws of the Omsk region in the field of electoral legislation with the Federal Law of June 12, 2002 No. 67-FZ “On the basic guarantees of electoral rights and the right to participate in a referendum of citizens of the Russian Federation.”

Given that the legislation of the Omsk region on elections and referendums has not been codified, similar provisions of the laws relating to the establishment of terms, conditions, etc. should be unified.

Legislation on the status and procedure for the formation of public authorities of a constituent entity of the Russian Federation and on public service in a constituent entity of the Russian Federation

In 2014, changes were made to the Code of Public Positions of the Omsk Region and the State Civil Service of the Omsk Region.

Law of the Omsk Region dated April 23, 2014 No. 1624-OZ “On Amendments to the Code on Public Positions of the Omsk Region and the State Civil Service of the Omsk Region”, certain provisions of the Code regulating the material support of state civil servants are amended in accordance with Resolution of the Supreme Court of the Russian Federation dated December 18, 2013 No. 50-APG13-12.

In addition, the qualification requirements for length of service in the state civil service for persons with specialist or master's degrees with honors have been changed. The Law of the Omsk Region dated June 2, 2014 No. 1636-OZ “On Amendments to the Code on Public Positions of the Omsk Region and the State Civil Service of the Omsk Region” clarified the procedure for calculating pensions for long service to persons holding public positions in the Omsk Region , positions of the state civil service of the Omsk region.

The Law of the Omsk Region dated December 25, 2014 No. 1700-OZ "On Amendments to the Code on Public Positions of the Omsk Region and the State Civil Service of the Omsk Region" was prepared in connection with the adoption of the Federal Law dated 28 December 2013 No. 400-FZ "On insurance pensions" and provides for the replacement of the concept of “labor pension” with the concept of “insurance pension”.

In the Omsk region, the opportunity of a constituent entity of the Russian Federation to establish the specifics of determining the tax base for the property tax of organizations has not been used. The procedure for compiling such a List requires the development of recommendations at the federal level.

Further improvement of the legislation on taxes and fees should be aimed at creating incentives for increasing the tax base in the Omsk region and using the powers granted to the constituent entity of the Russian Federation in the field of tax legislation in full.

The basics of property management in the Omsk region and the procedure for exercising the powers of the owner by state authorities of the Omsk region, organizations, officials and other persons in relation to property owned by the right of ownership of the Omsk region are established by the Law of the Omsk region dated July 6, 2005 No. 652-OZ " On property management of the Omsk region."

The Law of the Omsk Region dated December 10, 2014 No. 1691-OZ “On Amendments to the Law of the Omsk Region “On the Regulation of Land Relations in the Omsk Region” provides for the empowerment of the Government of the Omsk Region to approve the procedure for the implementation by executive authorities of the Omsk Region of activities aimed at for the release of land plots from unauthorized buildings, movable property established without legal grounds, by a specially authorized body – act on behalf of the Omsk region as a tenant under land lease agreements.

Significant changes in the legislation of the Russian Federation, aimed at improving the regulation of land disposal processes, require further adjustments to the provisions of the Law of the Omsk Region of February 8, 2006 No. 731-OZ “On the regulation of land relations in the Omsk Region.”

Within the framework of the competence established by the Law of the Russian Federation of February 21, 1992 No. 2395-1 “On subsoil”, the Law of the Omsk Region of December 29, 2001 No. 334-OZ “On state regulation of the use of subsoil in the territory of the Omsk Region” was adopted.

In order to bring the regional law into conformity with the Federal Law of the Omsk Region dated March 24, 2014 No. 1620-OZ “On amending Article 10.1 of the Law of the Omsk Region “On state regulation of subsoil use in the Omsk Region” to the powers of executive authorities The Omsk region in the sphere of regulation of subsoil use relations is assigned the authority to draw up documents (regarding subsoil plots of local significance), which certify the specified boundaries of the mining allotment (mining allotment act and graphic appendices) and are included in the license for the use of subsoil as its integral part, in cases established by the Government of the Russian Federation.

Law of the Omsk Region dated December 25, 2014 No. 1699-OZ “On Amendments to Articles 1 and 10 of the Law of the Omsk Region “On State Regulation of Subsoil Use in the Omsk Region” excludes the authority of the Government of the Omsk Region in terms of establishing the payment procedure and amounts state and incentive monetary rewards for identifying deposits of common minerals in the Omsk region.

Relations in the sphere of use of forests located on the territory of the Omsk region are regulated by the Law of the Omsk region dated December 6, 2007 No. 981-OZ “On the regulation of forest relations in the Omsk region.”

Changes to this Law in 2014 were due to changes in federal legislation.

In particular, the laws of the Omsk region dated June 2, 2014 No. 1633-OZ “On amendments to certain laws of the Omsk region in connection with the adoption of the Federal Law “On the contract system in the field of procurement of goods, works, services to provide state and municipal needs" and dated June 27, 2014 No. 1644-OZ "On amendments to the Law of the Omsk Region "On the regulation of forest relations in the Omsk Region" The terminology used in regional laws was brought into compliance with federal legislation, and certain powers of the Government of the Omsk Region and other executive authorities of the Omsk Region in the field of forest relations were clarified.

Relations aimed at preserving and restoring the natural environment, rational use and reproduction of natural resources, preventing the negative impact of economic and other activities on the environment and eliminating its consequences in the Omsk region are regulated by the Law of the Omsk Region dated October 6, 2005 No. 673 -OZ "On environmental protection in the Omsk region."

Changes to this Law in 2014 are due to changes in federal legislation.

Law of the Omsk Region dated December 25, 2014 No. 1703-OZ “On Amendments to the Law of the Omsk Region “On Environmental Protection in the Omsk Region”” medical and recreational areas and resorts were excluded from the list of categories of specially protected natural areas, other categories were established specially protected natural areas of regional and local significance, the powers of state authorities of the Omsk region in matters of organization, protection and use of specially protected natural areas have been changed.

The main regulatory legal act of the Omsk region, which establishes measures of social support for citizens living in the region, is the Code of the Omsk Region on the social protection of certain categories of citizens. In 2014, the following changes were made to it.

The Law of the Omsk Region dated March 4, 2014 No. 1613-OZ “On Amendments to the Code of the Omsk Region on Social Protection of Certain Categories of Citizens” established social support measures in the form of an additional payment to the old-age labor pension for citizens of the Russian Federation living in the territory of the Omsk Region region and filled the elected positions of heads of municipal districts of the Omsk region, as well as filled on a permanent basis the positions of chairmen (deputy chairmen) of representative bodies municipal districts of the Omsk region for two or more terms, whose powers in the relevant position ceased no earlier than December 19, 2004.

Law of the Omsk Region dated March 4, 2014 No. 1615-OZ “On Amendments to the Code of the Omsk Region on Social Protection of Certain Categories of Citizens” excludes the formation of the funded part of the labor pension of women who gave birth from the list of directions for disposing of funds of regional maternal (family) capital (who adopted) a third child or subsequent children after January 1, 2011. The Code includes provisions defining the categories of children taken into account as part of the family when assigning a monthly allowance to families with five or more children. These categories have been expanded to include children taken into foster care. At the same time, the right to receive benefits for children for whose maintenance the guardians (trustees) are provided with funds in accordance with the Code is excluded. Thus, families with the same number of children are equal in the right to receive benefits for born (adopted, ward) children.

An amendment has been made to the Code providing for payments to guardians who have entered into an agreement on guardianship of adult incompetent citizens, which helps to increase the level of social security of incapacitated citizens living in the region and in need of guardianship, ensuring the protection of their rights and legitimate interests.

Law of the Omsk Region dated November 6, 2014 No. 1675-OZ "On Amendments to the Code of the Omsk Region on Social Protection of Certain Categories of Citizens" and Law of the Omsk Region dated December 25, 2014 No. 1702-OZ "On Amendments to the Code of the Omsk Region" region on social protection of certain categories of citizens" were adopted in order to ensure the implementation of the powers of public authorities of the Omsk region in the field of social services from January 1, 2015, provided for by Federal Law No. 442-FZ of December 28, 2013 “On the fundamentals of social services for citizens in the Russian Federation.”

Law of the Omsk region dated June 2, 2014 No. 1640-OZ “On amendments to certain laws of the Omsk region” provides for amendments to the Law of the Omsk region “On labor protection in the Omsk region” and the Law of the Omsk region “On quotas for jobs in Omsk region."

The introduction of changes is associated with the adoption of federal laws dated December 28, 2013 No. 426-FZ "On special assessment of working conditions" and dated December 28, 2013 No. 421-FZ "On amendments to certain legislative acts of the Russian Federation in connection with the adoption Federal Law "On Special Assessment of Working Conditions", by which the legal institution of "certification of workplaces according to working conditions" is replaced by "special assessment of working conditions", and The powers of the executive authorities of the constituent entities of the Russian Federation in the field of labor protection have also been changed. The Law of the Omsk Region of December 4, 2014 No. 1684-OZ “On Amendments to the Law of the Omsk Region “On Remuneration of Workers of Organizations Financed from the Regional Budget” excluded Article 3 “Tariff System of Remuneration”, which is due to the non-application at present time in organizations financed from the regional budget, tariff systems of remuneration.

In order to bring the legislation of the Omsk region in the field of health protection into line with the changed federal legislation, amendments were made three times to the Law of the Omsk Region dated June 7, 2012 No. 1450-OZ “On the protection of health of the population of the Omsk region.”

The Law of the Omsk Region dated October 2, 2014 No. 1663-OZ “On Amendments to the Law of the Omsk Region “On Protecting the Health of the Population of the Omsk Region” clarifies certain powers of the Ministry of Health of the Omsk Region, and also provides for a postponement of the entry into force of certain provisions of the Law .

The Law of the Omsk Region dated December 25, 2014 No. 1707-OZ “On Amendments to the Law of the Omsk Region “On the Protection of Health of the Population of the Omsk Region” clarified certain powers of the Government of the Omsk Region, including establishing the procedure for creating a list of medical organizations providing high-tech medical care.

Law of the Omsk region dated June 27, 2014 No. 1641-OZ “On amendments to certain laws of the Omsk region in terms of clarifying certain provisions of regional laws on issues of protecting the health of citizens” amended 5 regional laws in order to bring them into compliance with Federal Law of November 25, 2013 No. 317-FL "On Amending Certain Legislative Acts of the Russian Federation and recognition of certain provisions of legislative acts of the Russian Federation on the protection of the health of citizens in the Russian Federation who have lost the strength of the certain provisions. The adoption of such complex laws ensures the systematic and consistency of regulatory legal acts of the Omsk region by establishing a uniform approach to regulating public relations in various fields.

In 2014, financing for health and public health costs was carried out in accordance with the Law of the Omsk Region dated December 26, 2013 No. 1600-OZ "On the budget of the Territorial Fund for Mandatory Medical Insurance of the Omsk Region for 2014 and for the planning period 2015 and 2016 Years ", in which the changes were made by three regional laws.

The specified changes were associated with the adjustment of the numerical indicators of the revenue and expenditures of the budget of the territorial fund of compulsory medical insurance of the Omsk region, the redistribution of budget allocations, as well as clarifying the codes of the budget classification of the Russian Federation. 

The Law of the Omsk Region dated December 4, 2014 No. 1685-OZ "On the budget of the Territorial Fund for Compulsory Medical Insurance of the Omsk Region for 2015 and for the planning period of 2016 and 2017".

The total amount of budget expenditures of the Territorial Fund of Compulsory Medical Insurance of the Omsk Region for 2015 is determined in the amount of 18 098 574.5 thousand rubles, balanced with the revenue part of the budget of the territorial fund of compulsory medical insurance of the Omsk region.
